These Terms of Service (“Terms”) govern your access to and use of Planet Snake (“the Service”), a free browser-based multiplayer game. By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service (or 16 if you live in the European Economic Area or the United Kingdom). By using the Service you represent that you meet this minimum age. If you are under the age of legal majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian.
2. Your account
You can play as a guest without creating an account. If you sign in with Google or Facebook, an account is created for you so that your progress, friends list, and statistics are saved across sessions. You are responsible for the activity that takes place on your account and for keeping access to your linked sign-in provider secure.
You agree to provide accurate information when prompted (for example, choosing a nickname that you are entitled to use), and to keep your account information up to date.
3. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, or in violation of any applicable local, national, or international law;
- choose a nickname that is hateful, harassing, sexually explicit, impersonates another person, or infringes someone else’s rights;
- cheat, exploit bugs, run modified clients or bots, automate inputs, or otherwise interfere with fair play;
- attempt to disrupt, overload, or attack the Service or its infrastructure (including denial-of-service, scraping at scale, or unauthorised access attempts);
- attempt to gain access to other users’ accounts, sessions, or personal data;
- reverse-engineer, decompile, or otherwise attempt to extract the source of any non-public part of the Service, except to the extent permitted by mandatory law;
- harass, threaten, or harm other players (for example by coordinated targeting); the follow / block features are provided so you can curate your own experience;
- use the Service to transmit viruses, malware, or other harmful code.
4. User-supplied content
The only content you supply to the Service is your nickname and a handful of profile preferences (snake colour, language, avatar variant). You are responsible for the nickname you choose. By submitting it, you grant us a worldwide, non-exclusive, royalty-free licence to display it to other players in the contexts where it appears (in-game, leaderboards, your public profile, follower lists). You retain whatever rights you originally had in it.
5. Intellectual property
The Service, including its source code, design, artwork, sound, gameplay mechanics, and trademarks, is owned by us or our licensors. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own non-commercial entertainment in accordance with these Terms. No other rights are granted.
6. Third-party services
The Service relies on third-party providers — including OAuth sign-in (Google, Facebook), avatar image services (DiceBear, Boring Avatars, RoboHash, Pravatar), and Google AdSense (advertising) — when you choose to use those features or visit pages where ads are shown. Your use of those services is also governed by their own terms and policies. We are not responsible for their content, availability, or practices. The Privacy Policy describes which data flows to which third party and on which surfaces.
7. Service availability
The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. We may modify, suspend, or discontinue the Service (in whole or in part) at any time, including without notice for emergency maintenance or to address abuse.
8. Termination
You may stop using the Service at any time. We may suspend or terminate your access (and delete or disable any associated account) if we reasonably believe you have breached these Terms, if your use poses a risk to the Service or other users, or if we are required to do so by law. We will use reasonable efforts to notify you when this happens, except where doing so would be counter-productive (for example in response to ongoing abuse).
9. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that your use of the Service will be secure, uninterrupted, or error-free.
10. Limitation of liability
To the maximum extent permitted by law, in no event will we, our contributors, or our service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with the Service or these Terms — even if we have been advised of the possibility of such damages. Our aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you have paid us in the twelve months before the claim (which, for a free service, will typically be zero) or (b) USD 50.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above limitations may not apply to you. Nothing in these Terms limits any liability that cannot be limited by law (such as for fraud or for death or personal injury caused by negligence).
11. Indemnity
You agree to defend, indemnify, and hold us harmless from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your violation of these Terms, (b) your misuse of the Service, or (c) your infringement of any third-party right.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Effective date” above. If the changes are material we will take reasonable steps to notify signed-in users. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of your country of residence to the extent its mandatory consumer protection rules apply, and otherwise by the laws of the jurisdiction in which the operator of the Service is established, without regard to conflict-of-law principles. You and we agree to first try in good faith to resolve any dispute informally by contacting us at the address below.
14. Miscellaneous
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
